Copyright policy
Version 1 · A draft our lawyer is still checking
Stackapella lets people record harmonies and share them by link. We respect copyright, and we expect everyone who shares on Stackapella to do the same. The songs in our library are in the public domain, our arrangements are under CC BY-SA 4.0, and our guide recordings are licensed to you to sing with and share inside your harmonies (see the terms). A harmony you share must be your own singing or playing.
Sending a formal copyright notice (DMCA)
If you believe a shared harmony infringes your copyright, send a notice to [email protected].
Your notice must include:
1. your physical or electronic signature; 2. the copyrighted work you believe is infringed; 3. the link to the shared harmony (`https://stackapella.com/h/...`) or the template in the library; 4. your name, address, telephone number and email address; 5. a statement that you believe in good faith that the use isn't authorised by you, your agent or the law; 6. a statement, under penalty of perjury, that the notice is accurate and that you are the owner, or authorised to act for the owner.
When we receive a complete notice, we take the page (or the template) down at once and tell the person who shared it, with a copy of the notice (your contact details are removed unless the law requires them). Projects people already made from a template keep their copy.
Counter-notice
If your harmony was taken down and you believe that was a mistake (for example, it's your own singing of a public domain song), you may send a counter-notice to the same agent with:
1. your physical or electronic signature; 2. the link to the harmony that was taken down; 3. a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification; 4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal court for your address (or, outside the United States, any judicial district in which Stackapella may be found), and that you will accept service of process from the person who sent the notice.
We pass the counter-notice to the person who sent the notice. Unless they tell us within 10 to 14 business days that they have filed a court action, we may restore the page.
Repeat infringers
An account whose shared harmonies are taken down for copyright three times may lose sharing, or be closed. Each takedown is recorded, and we look at the account before acting.
In the European Union and the United Kingdom
Anyone may report content they believe is illegal with the Report button, without an account. We review every report, and when we take something down we tell the person who shared it why, and how to ask us to look again.
